7:00 PM the Planning Board meeting was called to order.

PUBLIC HEARING DEFINITIVE SUBDIVISION: D. Lindberg read the Public Hearing Notice into record.

ALDEN WOODS II, Extension of Time - C. B. Blair Development Corp.

ALDEN WOODS I, Street Acceptance: Alden Woods I is on the warrant for street acceptance. As part of the approval process the applicant was required to construct a sidewalk between the two subdivision roadways on Chapel Street. It is unlikely that the construction will be completed by the May Town Meeting. The applicant has requested to incorporate the condition for construction of the sidewalks into the decision for Alden Woods II. The Town has requested a design plan prior to the start of construction. As-builts have not been received for the subdivision, and the detention ponds are currently being cleaned.

This is the first extension of time for Alden Woods II. The original decision was issued on May 23, 2006, and expires on May 23, 2009. Construction of the roadway is near completion with the exception of a topcoat of pavement. There are a total of 18 lots including ANR's. Eleven (11) building permits have been issued. There are still some erosion issues. Some of the haybales and silt fencing needs to be refreshed and will be specified in the draft. Some mowing and dredging of the detention ponds are needed as conditions for Alden Woods I. The original decision was the result of a court order and includes general conditions. The Board has a copy of the decision review.

Board Comments:

W. Ritter: Sidewalks should have been finished in Alden Woods I. He didn't think they should bring the 'sidewalks' into the decision for Alden Woods 2. Dan Hazen, DPW Engineer, is not sure why they have not been done yet.

C. Stanovich: Asked when will it be done. D. Hazen is in the process of getting easements on Chapel Street to go across their lots.

W. Ritter motioned to close the Public Hearing. O. Lies seconded. All in favor.

W. Ritter motioned and read the conditions for approval into record. O. Lies seconded the motion. W. Ritter amended the motion to include changes to #32. All in favor. Approved.

W. Ritter recommended against the street acceptance of Alden Woods I at the May Town Meeting. C. Stanovich seconded. All in favor. P. Harding will write a detailed letter explaining why the streets are not accepted. There is no Bond in place for sidewalks on Chapel St.

PUBLIC HEARING, DEFINITIVE SUBDIVISION, Extension of Time Stoney Brook Estates, Blair Enterprises, Inc.: D. Lindberg read the Public Hearing Notice into record. Construction of the subdivision has not commenced. The applicant has recently received approval from the Massachusetts Environmental Protection Agency of the Final Environmental Impact Report. A Forest Cutting Plan for the property was filed with the state and trees have been tagged, no timber has been harvested. The original decision was issued on May 23, 2006, and expires on May 23, 2009. The decision resulted from a court order and includes general conditions. An amendement was issued in June 2008 for an alternate roadway entrance, which avoided a wetland crossing.

A. Bonofiglio motioned to close the Public Hearing. W. Ritter seconded. All in favor.

The June 2008 amendment was not included in the draft.

W. Ritter motioned to approve and read the extension of time into record. W. Ritter changed the date from May 23, 2012, to May 23, 2011 a two year extension. C. Stanovich seconded. All in favor. Approved.

UPDATE ON EAGLEVILLE HISTORIC DISTRICT: There were approximately twenty people in attendance at the April 28, 2009 meeting regarding creation of the Eagleville Historict District. The proposal will create a Historic District on the National Register of Historic Places. Properties located within the district may be considered non-contributing if construction occured within the last 50 years. All properties in the district will have a choice whether to participate. If they choose to participate, they must agree to meet exterior historical renovation standards, in exchange for a tax deduction. Dennis Lipka will be meeting with the Holden Historic District Committee on June 10th to review the proposal and determine if there is interest in adopting a local district Zoning By-Law.

OTHER BUSINESS:

Vice Chair: D. Lindberg said that since R. Ricker left, who will be Vice-Chair? C. Stanovich motioned to nominate W. Ritter as Vice Chair in R. Ricker's absence. A. Bonofiglio seconded. All in favor.

G. M. Bergeron: Recommended calling the abutters on the Bergeron property. The bank has spoken to P. Harding, who sent a letter to the bank.  The property is under covenant. Whoever buys the project will have to buy the entire project.

Holden Clock: W. Ritter mentioned that the Mass Law Review has the Holden Town Clock on the cover. There was also some mention of 40R included in that issue.

Jefferson Mills: P. Harding has comments from the Fire Chief with concerns regarding the access road/loop. He recommended moving it within 200' closer to the roadway.

Windmills: M. Wronski informed the Board that he read that Millbury passed a Windmill By-law. Windmills to be on next agenda.
